PASSED: Senate Bill 614* The obligation of a property owner, lot owner or homeowner in a planned community containing no more than twelve units which is not subject to any development rights or a planned community that provides in its declaration that the annual average common expense liability of all units  restricted  to  residential  purposes,  exclusive  of  optional  user  fees  and  any  insurance premiums  paid  by  the  association,  may  not  exceed $300 as  adjusted pursuant  to  section  one hundred fourteen, chapter one, article thirty-six-b of this code, or the efforts of property owners’ associations or homeowners’ associations to collect the same to pay dues, assessments, costs or fees of any kind to a property owners’ association or homeowners’ association.

PASSED: House Bill 2801 A county commission may designate areas of special or unique interest, with sites, buildings and structures within those areas, which are of local, regional, statewide or national significance. An area that has been so designated does not limit the use of nor require any alteration of any privately owned property in the area for any purpose.

* Clarifies HOAs can use a fine method in obtaining delinquent annual assessments. They are NOT a debt collector as defined in the Consumer Protection Act.

This Committee is looking for approximately four to six (4-6) Cloverdale volunteers to join our committee and provide their thoughts and suggestions for a new rule to be developed and presented to the Board of Directors for their consideration.By June 18 the Committee would like to have the volunteers organized so information can be distributed and a meeting can be arranged before the end of June. The Committee is interested in volunteers with varying opinions on this matter to obtain a variety of points of views and put together at least one proposed rule to be presented to the Board for discussion at the next meeting Tuesday July 7, 2015.

Whether you are finishing your spring cleaning around the yard or clearing up after a summer storm the Jefferson County Solid Waste Authority has you covered. Tree trimmings, down limbs, leaves, grass clippings and all other plant materials are all accepted for recycling for $32.00 per ton (0.02 per pound).

All Yard Waste Material is weighed in at the scale and directed to the yard waste unloading area. All material must be removed from plastic bags and only natural materials are accepted (no trash or scrap wood). The collected yard waste is recycled by grinding it into mulch and/or compost.

ATVs are not permitted to be ridden on any  Cloverdale roads or property of homeowners. June 17, 2004 – It shall be unlawful for any person to operate an all-terrain vehicle, as defined in W.VA.         Jefferson County Commission Public Hearing

        About NEW ZOINING  being recommended by the Planning  Commission.
        The County Commission voted last year to defer action on creating new zones until the Comprehensive Plan is complete.  But Commissioner Pellish urged the Planning Commission to resubmit them as he believes the politics on the County Commission have changed.

I hope those who agree no action should be taken on these new zones until the Comprehensive Plan is finished will let their views be known either in writing or in person.

        Overview, talk with Power Point Eminent Domain  PATH
        Charles Printz, an attorney in Martinsburg, WV, gave a presentation to the Berkeley County, WV Farm Bureau last summer.  It is an excellent 20 minute lecture that explains what land owners can expect in the court process if power companies want your land for their power lines. Land owners should understand that there is a very good chance that they will receive more in damages from going to court than they will if they accept the power companies’ offers.  You will need to hire an attorney and a real estate appraiser to make your case, but you will more than recover their fees. If you go to court, you have the right to ask for a jury trial with a jury of 12 of landowners from your county.  Do not believe power company land agents when they try to scare you about the court process.  There is nothing to fear.

        WV PSC Turns Tail and Runs from PATH FERC Case
        Just as settlement discussions are reaching a conclusion, what does the WV PSC do?  They cut and run.  Yup.  Last week, the WV PSC filed a letter withdrawing from the PATH abandonment case.  That is the case in which AEP/FirstEnergy are trying to dump millions of dollars of unrecovered costs for their failed PATH project on WV rate payers. AEP/FirstEnergy want $121 million in all from all rate payers in PJM Interconnection’s region.One thing is certain, the WV PSC doesn’t care about our electric rates going up.  Two WV citizens, Alison Haverty and Keryn Newman have been fighting PATH’s bogus rate increases for the past four years with no help from either the WV PSC or the WV Consumer Advocate.  Two other WV citizens, in addition to citizens from MD, have filed as intervenors in the FERC abandonment case, but the WV PSC hasn’t got the time or the interest to stick around and fight for West Virginians.         I (Cloverdale Homeowner) had a man stop at our house today trying to sell magazines, claiming to raise points for himself for a $5000 reward as part of a program.  He said he had Tourette’s syndrome and it was an organization for such health issues.  I declined to buy any and he went on his way.  He was walking.  Was a rather short man, probably 30 years old, wearing a red jacket.  He told me his name was James. I don’t know if it was legit or not, but definitely creeped me out.  I called to warn some neighbors who I knew were home.  He was nice and all, but the whole situation creeped me out.  I thought other people might like to be warned in case of future instances

        A regional disaster exercise will occur on Saturday, September 8th in Jefferson County and the surrounding region.  Citizens are advised that they may see or hear exercise activities on Saturday, as a “river rescue” using Jefferson County’s Swift Water assets will test plans, procedures, and capabilities as they pertain to a severe flooding and dam release incident on the Potomac River.   Additionally, the Jefferson County Emergency Operations Center (EOC) will be activated throughout the day exercising their plans, procedures, and capabilities to activate,  staff, operate and deactivate the EOC in response to such an event.  Be advised that is only an exercise.

        The Jefferson County Planning Commission has proposed new zoning ordinances that could affect our neighborhood.  The new zoning allows for “floating zoning” meaning that any residential neighborhood could have a commercial business right next door.
